RELEASE, WAIVER, AND INDEMNIFICATION AGREEMENT

This agreement applies to all Lockwood Hits, LLC activities, including private lessons, group instruction, sandlot games, game nights, and events (together, "Activities"). By agreeing, you confirm you are the parent or legal guardian of the participant and you agree on behalf of yourself and the participant.

1. ASSUMPTION OF RISK

Baseball instruction, training, and game play involve inherent risks, including thrown and batted balls, swung bats, collisions, falls, equipment, weather, and field conditions, which can result in injury, illness, property damage, or death. I understand and voluntarily accept these risks on behalf of myself and the participant.

2. RELEASE AND WAIVER

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, AND DISCHARGE LOCKWOOD HITS, LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, INSTRUCTORS, EVENT ORGANIZERS, VOLUNTEERS, AGENTS, AND SPONSORS, AND THE OWNERS, OPERATORS, AND LESSORS OF ANY FACILITY OR PROPERTY WHERE ACTIVITIES TAKE PLACE (TOGETHER, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO THE PARTICIPANT'S INVOLVEMENT IN ANY ACTIVITY, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

3. HOLD HARMLESS AND INDEMNIFICATION

I agree to hold harmless, defend, and indemnify the Released Parties from and against any claims, liabilities, damages, or expenses, including reasonable attorney's fees, brought by or on behalf of the participant or any third party, arising out of the participant's involvement in any Activity.

4. MEDICAL AUTHORIZATION

In an emergency, I authorize the Released Parties to obtain medical treatment for the participant at my expense. I represent that the participant is physically able to participate.

5. MEDIA RELEASE

I grant Lockwood Hits, LLC permission to use photos and video of the participant for promotional purposes without compensation. I may revoke this permission in writing at any time.

6. GENERAL

This agreement is governed by Texas law. If any provision is found unenforceable, the remainder stays in full effect. This agreement remains in effect for all current and future Activities unless revoked in writing.

HOW YOU AGREE: By typing your full legal name in the waiver question of the booking form, you electronically sign this agreement and agree to all of its terms on behalf of yourself and the participant, effective as of the date of your booking.
